1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Coaster Card Collector (the "Service"), operated by Steele ("we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. Eligibility & Accounts
- You must be 13 years of age or older to use the Service, create an account, or create a guest profile. At signup, you will be asked to confirm you are 13 or older; anyone who indicates they are under 13 will not be permitted to create an account or guest profile. See our Privacy Policy for more on our approach to children's privacy.
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- If you are under the age of majority in your jurisdiction but 13 or older, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf, where required by law.
- You must notify us promptly at sturgy.gfx@gmail.com of any unauthorized use of your account.
3. The Service
Coaster Card Collector is a free, mobile-first web application that allows users to collect, organize, and trade digital roller-coaster-themed trading cards with other users. We may add, change, or remove features at any time, and we do not guarantee that the Service will always be available, uninterrupted, or error-free.
4. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Harass, abuse, threaten, or impersonate other users;
- Attempt to gain unauthorized access to other accounts, systems, or data;
- Use bots, scrapers, or automated tools to access or manipulate the Service, including artificially inflating collections or manipulating trades;
- Upload or share content that is illegal, infringing, hateful, or sexually explicit;
- Sell, buy, or attempt to exchange digital cards or accounts for real-world money or cryptocurrency outside features we may explicitly provide for that purpose;
- Interfere with or disrupt the integrity or performance of the Service.
We reserve the right to investigate and take appropriate action, including removing content or suspending accounts, for violations of this section.
5. User Content & Trading
"User Content" means any information, profile details, messages, or other content you submit to the Service. You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit your User Content as necessary to operate the Service (for example, showing your username and trade activity to other users).
Trades between users are conducted at each user's own discretion and risk. We do not guarantee the accuracy, fairness, or outcome of any trade and are not responsible for disputes between users arising from trades.
6. Intellectual Property
The Service, including its design, code, all digital card artwork and imagery, logos, and the "Coaster Card Collector" name, is owned by us and is protected by intellectual property laws. All card artwork and imagery is our own original work; we do not use any officially licensed images from theme parks, ride manufacturers, or other third parties. Except for the limited rights granted to use the Service and any digital cards within it as intended, no other rights are granted to you.
The Service may reference the names of real roller coasters, theme parks, or manufacturers (for example, to identify which real-world ride a card is themed after). These references are used descriptively and are not sponsored, endorsed, or affiliated with the parks, manufacturers, or trademark owners in question. All applicable trademarks remain the property of their respective owners.
7. No Fees; No Real-World Value
Coaster Card Collector is currently free to use, and we do not charge fees or process payments. Digital cards within the Service have no monetary value, cannot be redeemed for cash, and are not a form of currency, security, or investment. We may introduce paid features in the future, in which case these Terms will be updated accordingly before any such features go live.
8. Suspension & Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or for any other reason at our discretion, including discontinuing the Service entirely.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
12. Governing Law & Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence (such as EU/UK consumer rights) apply and cannot be waived. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Massachusetts, unless applicable law requires otherwise.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
